Electronic Membership Agreement, Assumption of Risk & Liability Waiver

By checking the acknowledgment box and electronically signing this Agreement, I understand that my electronic signature is legally binding and has the same force and effect as a handwritten signature.

1. Assumption of Risk

I understand that participation in martial arts, mixed martial arts (MMA), Brazilian Jiu-Jitsu (BJJ), wrestling, boxing, kickboxing, Muay Thai, strength and conditioning, fitness classes, open mat sessions, sparring, competitions, private lessons, and all other activities offered by FOB MMA involves inherent risks.

These risks include, but are not limited to:

• Cuts and bruises
• Sprains and strains
• Broken bones
• Joint injuries
• Concussions and head injuries
• Neck and spinal injuries
• Permanent disability
• Paralysis
• Illness
• Death

I voluntarily choose to participate and knowingly assume all risks, both known and unknown, associated with participation.

2. Release of Liability

To the fullest extent permitted by Indiana law, I release and forever discharge FOB MMA, Forward Operating Base (FOB), its owners, officers, directors, employees, volunteers, coaches, instructors, contractors, members, affiliates, sponsors, landlords, and representatives from any and all claims, demands, damages, actions, causes of action, or liability arising from my participation in any activity at FOB MMA, except where caused by gross negligence or willful misconduct.

3. Medical Treatment

I certify that I am physically capable of participating in martial arts and fitness activities.

I understand that FOB MMA is not responsible for determining my medical fitness.

If emergency medical treatment becomes necessary, I authorize FOB MMA to obtain emergency medical care on my behalf if I am unable to do so. I understand that I am solely responsible for all medical expenses incurred.

4. Personal Property

I understand that FOB MMA is not responsible for lost, stolen, or damaged personal property, including but not limited to:

• Clothing
• Jewelry
• Phones
• Wallets
• Equipment
• Vehicles
• Other personal belongings

5. Rules and Conduct

I agree to:

• Follow all gym rules and instructor directions.
• Use equipment safely.
• Treat all members and staff with respect.
• Maintain proper hygiene.
• Wear appropriate training attire.
• Immediately report injuries.

FOB MMA reserves the right to suspend or terminate membership without refund for unsafe, abusive, illegal, or disruptive conduct.

6. Physical Contact

I understand that martial arts involve close physical contact including grappling, takedowns, striking drills, clinching, submissions, and controlled sparring.

I voluntarily consent to this contact.

7. Communicable Diseases

I understand that participation may expose me to communicable illnesses, including COVID-19, influenza, MRSA, ringworm, staph infections, and other contagious diseases.

I voluntarily assume these risks.

I agree not to attend training while experiencing symptoms of illness or while knowingly carrying a contagious condition.

8. Photo & Video Release

I grant FOB MMA permission to photograph or record me during training, classes, seminars, competitions, or events.

I authorize FOB MMA to use these photographs or videos for marketing, advertising, promotional materials, social media, and website content without compensation.

If I do not wish to appear in promotional materials, I understand that I must notify FOB MMA in writing.

9. Membership Policies

I understand that membership fees, billing policies, cancellations, freezes, and refunds are governed by my membership agreement.

This Liability Waiver remains in effect regardless of changes to my membership status unless revoked in writing and accepted by FOB MMA.

10. Minor Participants

If signing on behalf of a minor, I certify that:

• I am the parent or legal guardian.
• I have authority to sign this Agreement.
• I consent to the minor’s participation.
• I assume all risks on behalf of the minor.
• I release FOB MMA from liability to the fullest extent permitted by law.

11. Severability

If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.

12. Governing Law

This Agreement shall be governed by the laws of the State of Indiana.

Any legal action arising under this Agreement shall be brought in a court of competent jurisdiction located in Allen County, Indiana.

13. Acknowledgment

By electronically signing below, I certify that:

• I have read this entire Agreement.
• I understand its contents.
• I understand that I am giving up certain legal rights.
• I voluntarily agree to its terms.
• I am at least 18 years old, or my parent/legal guardian has signed on my behalf.
